WARNING / LEGAL NOTICE

TO ALL INVOLVED PUBLIC AUTHORITIES, MUNICIPAL BODIES, AND OFFICIALS

This warning and legal notice is published in connection with the prepared and systematically compiled documentary dossier concerning serious violations of fundamental human rights, procedural safeguards, and the fundamental principles of the rule of law within the territory of the Kingdom of Norway.

At present, the collected materials, evidence, procedural documents, and information concerning specific officials have been systematically compiled for consideration within the framework of the relevant national and international legal procedures.

The materials encompass the activities of public authorities and municipal bodies, as well as specific officials whose involvement in the events under consideration is reflected in the documentary dossier.

A particularly significant part of the materials concerns the circumstances of the criminal prosecution arising from allegations that I had allegedly assaulted my own daughter, as well as accusations concerning defamation and insult.

The matter concerns not only the criminal prosecution itself, but also the circumstances in which the relevant accusations originated, the preparation and use of materials, the actions of specific officials, the alleged falsification of the criminal case, and the serious violations of my fundamental and procedural rights associated with these events.

The final outcome of the relevant criminal proceedings is of fundamental legal significance.

The court of first instance acquitted me in relation to the circumstances in question on the ground that my actions did not constitute a criminal offence.

Subsequently, the Buskerud Regional Prosecutor’s Office terminated the relevant criminal proceedings, likewise on the ground that my actions did not constitute a criminal offence.

Despite these outcomes of the criminal proceedings, and despite the considerable period of time that has elapsed since the events in question, the persons whose involvement is reflected in the collected materials have, in my position, not been subjected to serious and proportionate accountability for the violations of fundamental rights that occurred.

AUTHORITIES AND INSTITUTIONS WHOSE INVOLVEMENT IS REFLECTED IN THE MATERIALS

A separate and significant part of the documentary dossier concerns the actions and decisions of officials and employees of:

the administration of Øvre Eiker kommune;

Barnevernet of Øvre Eiker kommune;

the Øvre Eiker Police;

the administration and employees of Voksenopplæringen of Øvre Eiker kommune;

as well as other public and municipal authorities and specific officials whose involvement in the events under consideration has been established and reflected in the collected materials.

For each relevant individual, information has been or is being systematically compiled concerning the position held, the scope of official authority, specific actions and decisions, documents prepared or signed, information transmitted, participation in administrative and criminal procedural measures, and the consequences of the relevant decisions.

The circumstances surrounding the formation of the accusations, the origin of the materials used, the accuracy of the information contained in those materials, and the role of specific officials in initiating, documenting, transmitting, and subsequently using the relevant information are under examination.

FALSIFICATION OF THE CRIMINAL CASE AND FUNDAMENTAL RIGHTS

Particular attention in the dossier is devoted to the alleged falsification of the criminal case and of the materials used in the course of the criminal prosecution.

The actions of specific employees and officials, the origin of the evidentiary materials, the manner in which they were obtained and documented, the content of the relevant documents, the transmission of information between public and municipal authorities, and the possible interrelationship between the actions of different bodies are subject to legal assessment.

The seriousness of what occurred is determined not only by the criminal prosecution itself, but also by its consequences for human dignity, reputation, private and family life, and other fundamental rights.

At the same time, the outcome of the criminal proceedings is of fundamental significance: the court of first instance acquitted me on the ground that my actions did not constitute a criminal offence, and the Buskerud Regional Prosecutor’s Office subsequently terminated the criminal proceedings, likewise on the ground that my actions did not constitute a criminal offence.

For precisely this reason, the actions of the officials involved in the initiation and formation of the relevant criminal case constitute an independent subject of documentary and legal analysis.

EUROPEAN CONVENTION ON HUMAN RIGHTS

The prepared evidentiary dossier includes materials concerning serious violations of fundamental human rights.

In particular, the materials raise issues concerning violations of the guarantees provided for under Articles 3, 7, 8, 13, and 34 of the European Convention on Human Rights, as well as Article 1 of Protocol No. 1 to the European Convention on Human Rights.

The documentary record includes the relevant procedural documents, decisions, official correspondence, and other materials, which are being considered in conjunction with the consequences of the actions of public and municipal authorities and specific officials.

INDIVIDUAL RESPONSIBILITY

The principle of individual responsibility is of particular significance.

The matter concerns not only public and municipal institutions as such, but also specific officials who directly participated in the relevant events.

Accordingly, the materials have been structured according to the principle of individualisation:

specific individual — position held — specific action or decision — relevant document — consequences — alleged violation of fundamental rights.

Neither public office, nor affiliation with a municipal authority, nor the performance of official duties can in themselves eliminate the issue of individual responsibility for actions if their unlawful character is established in accordance with the procedures prescribed by law.

GLOBAL MAGNITSKY HUMAN RIGHTS ACCOUNTABILITY ACT

The relevant authorities and officials are hereby formally notified that the specific individuals whose involvement is reflected in the collected documentary materials have already been identified by name and included in the relevant list and materials submitted for consideration within the framework of the mechanisms provided under the Global Magnitsky Human Rights Accountability Act.

The materials have been submitted to the competent authorities of the United States of America. The matter is under consideration.

The relevant materials contain information concerning specific officials, the positions held by them, the nature of their involvement, the actions undertaken, the documentary materials, and the consequences of those actions.

Among other matters, the materials reflect the involvement of relevant officials and employees of the administration of Øvre Eiker kommune, Barnevernet of Øvre Eiker kommune, the Øvre Eiker Police, and Voksenopplæringen of Øvre Eiker kommune.

Accordingly, the issue of the individual responsibility of the persons concerned has moved beyond the framework of exclusively internal administrative consideration within the Kingdom of Norway.

Specific individuals have been identified by name.

The relevant list has been compiled.

The materials have been submitted.

The matter is under consideration.

INTERNATIONAL CONSIDERATION

The collected documentary record is also intended for use in the relevant international legal procedures and for submission to competent foreign authorities.

The materials contain information concerning the events in question, the actions of public and municipal authorities, the individual role of specific officials, and the consequences of those actions for fundamental human rights.

The passage of time does not eliminate the necessity of providing a legal assessment of what occurred.

On the contrary, the absence over a prolonged period of proportionate accountability for serious violations raises an additional question concerning the effectiveness of internal mechanisms of oversight, investigation, and legal protection.

PRESERVATION OF EVIDENCE

All materials relating to the events under consideration are of potential evidentiary significance.

These include official documents, electronic correspondence, internal communications, minutes and records, opinions and assessments, reports, registration records, police and prosecutorial materials, documents of municipal authorities, materials of Barnevernet, Voksenopplæringen, and other institutions involved in the events under consideration.

All relevant documents must be considered in their relationship to specific decisions, specific officials, and the resulting consequences.

FORTHCOMING CLAIMS FOR COMPENSATION FOR MATERIAL AND NON-PECUNIARY DAMAGE

In addition to the international procedures and the consideration of materials concerning specific officials, separate legal claims will be brought seeking compensation for the material and non-pecuniary damage caused.

A claim exceeding NOK 10,000,000 (ten million Norwegian kroner) will be brought against the administration of Øvre Eiker kommune in connection with the fact that, according to my position and the materials in my possession, the looting and loss of material valuables belonging to me were permitted to occur during the period of my illness.

Within the relevant judicial proceedings, the issue will be raised concerning the actions and omissions of officials of Øvre Eiker kommune, their duties during the relevant period, the information available to them, the measures taken or not taken, and the causal relationship between the actions or omissions of the municipal authorities and the material damage caused.

Separately, a claim for NOK 5,000,000 (five million Norwegian kroner) will be brought against Øvre Eiker kommune as compensation for non-pecuniary damage arising from the circumstances of the criminal case initiated following a complaint by the relevant municipal authorities, the alleged falsification of the criminal case, and the consequences caused as a result.

This claim relates to the nature and duration of the criminal prosecution, its consequences, the non-pecuniary and reputational harm caused, the interference with private and family life, and other consequences arising from the violation of fundamental rights.

Of fundamental significance in this regard is the fact that the court of first instance acquitted me on the ground that my actions did not constitute a criminal offence, while the Buskerud Regional Prosecutor’s Office subsequently terminated the relevant criminal proceedings, likewise on the ground that my actions did not constitute a criminal offence.

A separate claim for compensation in the amount of NOK 3,000,000 (three million Norwegian kroner) will be brought against the relevant police authority in connection with the alleged falsification of the criminal case and the relevant procedural materials, as well as the resulting consequences for my fundamental rights, dignity, reputation, and private life.

Within the judicial proceedings, the issue will be raised concerning the origin of the relevant materials, the manner in which they were obtained and documented, the accuracy of the information contained therein, the actions of specific officials and police officers, and the compliance of those actions with the requirements of law and fundamental procedural safeguards.

Accordingly, the claims to be brought are as follows:

More than NOK 10,000,000 — against Øvre Eiker kommune in connection with the material damage caused and the looting of my material valuables that was permitted to occur during the period of my illness.

NOK 5,000,000 — against Øvre Eiker kommune as compensation for non-pecuniary damage in connection with the circumstances and alleged falsification of the criminal case.

NOK 3,000,000 — against the relevant police authority in connection with the alleged falsification of the criminal case and procedural materials.

The total amount of the forthcoming claims therefore exceeds NOK 18,000,000 (eighteen million Norwegian kroner).
